What DOL's New York entry says

  • Overtime (premium pay after): Weekly - 40.
  • The New York minimum wage equals the federal minimum wage when set below the federal rate.
  • Residential workers ("live-in workers") receive premium pay for hours worked over 44 in a payroll week. Employers operating a factory, mercantile establishment, hotel, restaurant, freight/passenger elevator, or theater; or a building employing security guards, janitors, superintendents, managers, engineers, or firemen must provide 24 hours of consecutive rest each week. Domestic workers are entitled to 24 hours of consecutive rest each week, and receive premium pay if they work during such period.
  • Employees receive 1 hour of pay at minimum wage rate in addition to owed wages when spread of hours exceeds 10 hours, there is a split shift, or both.
  • The minimum wage in New York City, Nassau County, Suffolk County, and Westchester County is $17.00 per hour. The minimum wage in the remainder of the state is $16.00 per hour.

The federal floor: the Fair Labor Standards Act sets a federal minimum wage of $7.25 an hour. When a state's rate is higher, covered employers pay the state rate; when it is lower or there is none, employers covered by the federal law pay $7.25. Employers must pay the highest rate that applies, including any city or county rate.

How this page is built

Rates come from the U.S. Department of Labor's state minimum wage tables, which DOL last updated on July 1, 2026. Where a state labor office has published a change after that date, or a rate for 2027, we use the state's own statement and name it; we read every source on Nov 3, 2026. The weekly and yearly figures are plain arithmetic (hourly rate × 40 hours, and × 2,080 hours for 52 weeks), not earnings data. The job-pay table uses BLS estimates of what workers actually earned in May 2025, which include tips for tipped jobs.

  • City and county rates: some cities and counties set higher minimums; this page shows state rates only. Check your city or county.
  • Exemptions: state laws exempt some jobs and set different rates for some minors, students, trainees and small employers.
  • Legal advice: this page summarizes official tables. For a specific pay question, contact the state labor office or the U.S. Department of Labor at 1-866-487-9243.
